Terms and Conditions

CONTRACT:
Dan Smith provides a written contract containing these Terms and Conditions and the photographic services to be performed. The contract is to be signed by the client and returned to secure a booking.

PRE-WEDDING CONSULTATION:
The parties agree to a pre-event consultation (allow approx 1 hour) before the wedding day in order to plan and finalise the shooting times, locations, and client’s requests for specific photographs. This consultation should preferably occur between one to four weeks before the wedding.

COOPERATION:
The parties agree to cheerful cooperation and communication for the best possible results and that Dan Smith will make a reasonable, good faith attempt to capture all the required photographs during the event. Dan Smith therefore recommends that the client designates an "event guide" (someone close to the bride or groom) who will point out important individuals and help get them together for any formal photographs.
Dan Smith shall be the exclusive photographer retained by client and will be available for the whole day. Family and friends are permitted to take photographs as long as they do not disturb, disrupt or interfere with photographer’s duties. The photographer has the right to kindly ask the person obstructing to refrain from doing so, in order to carry on their duties. It is a good idea if your guests are aware of this before hand.
Requested photographs will not be possible if the subject is not willing or cooperative.
Any changes made that will affect your photography and the day, timings, venues etc should be notified as soon as possible in writing.

HOUSE RULES:
The client understands that some photos may not be possible because of the rules imposed by the ceremony official or venue. Dan Smith accepts no liability for the church, reception, hotel etc. having restrictions that prevent images being taken.

DIGITAL IMAGES and COPYRIGHTS:
The images, digital or paper, produced by Dan Smith are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without Dan Smith’s explicitly written permission. Upon final payment by the client, limited copyright ownership of the resulting images will be transferred to the client under the following conditions: The Prints, Reprints and Digital Images are the property of client for personal use only and may be reproduced for friends and relatives. The Client, however, must obtain written permission from Dan Smith if they wish to publish or sell any images for profit.

EXHIBITION and MODEL RELEASE:
The client grants Dan Smith permission to display images, including images where the client is included, for advertising purposes, as an example of Dan Smith’s photographic work . The client releases all claims to profits and liabilities that may arise from use of these images.

LIMIT OF LIABILITY:
In the unlikely event that Dan Smith is injured or becomes too ill to photograph the event, he will make every effort to secure a replacement photographer. If this situation should occur and a suitable replacement can not be found, responsibility and liability is limited to the return of all payments received for the event. Also, in the unlikely event that some or all digital photograph files from the event are lost, stolen, or destroyed for reasons beyond Dan Smith's control, his liability is based on the percentage of images that are lost.
Dan Smith cannot be held responsible for images and photography sessions being disrupted by adverse/unfavourable weather conditions.
The photographer cannot guarantee any specific image nor incorporate any specific background or group arrangement.
Any circumstances not bought to the attention of Dan Smith that affect the out come of the wedding photography will not be the responsibility of Dan Smith.
The liability of the photographer is limited to the return of any payments made to the photographer by the client.

FEES:
A booking fee of £125 is required to reserve the wedding date. The remaining balance is to be paid 7 days before the date of the wedding. Fees can be made using cheque (preferred) or cash. In the event of cancellation by the client, the booking fee paid is non-refundable. No images will be provided until the fees are paid in full.
Final agreed price will depend on the precise requirements of the client. Every wedding is different and therefore charged appropriately.
Payments are non refundable except in exceptional circumstances at the discretion of Dan Smith.
All prices are subject to change. Prices are adjusted periodically; future bookings will be priced at the time of booking.
Any additional services, prints, albums etc. ordered which are not included in the original package, with incur additional costs. All re-orders must be paid for in full prior to orders being dispatched.

QUALITY:
Clients should be aware that colour dyes in photography may fade or discolour over a period of time due to inherent quality of dyes and insufficient care and preservation of prints and albums.
The photographer will not be liable for degradation of images due to poor handling and insufficient care. Dan Smith cannot be held responsible for damage to CDs or DVDs provided; appropriate care is the client’s responsibility.
Heat and direct sunlight will reduce the life of your images. The photographer accepts no liability.
Dan Smith will not be held responsible for the lack of coverage caused by the bride and groom, wedding party, guests, not being on time or interfering or restricting the photographer’s duty.
The photographer will not be held responsible for customer disappointment of agreed images as long as they are technically acceptable and will face no liability.
The client is advised to keep all correspondence to and from Dan Smith

CANCELLATION:
If you cancel within 14 days of booking you will receive a full refund including your booking fee. If you cancel after 14 days your booking fee is not refundable. You may cancel by telephone, email or in writing.

COMPLAINTS:
Any complaints should first be raised by the Client with the Photographer/s in writing within 21 days from the date of receipt of images.
